ORDER

This petition has been filed against the Docket order dated 09.11.2023 (B Diary) on the file of the Principal District Munsif, Aruppukottai, Virudhunagar District.

2.Pending revision conditional order was passed by this Court upon the revision petitioner herein to deposit or pay the balance amount of Rs.2,00,000/- (Rupees Two Lakhs only). That was also deposited by the petitioner on 08.01.2024. The respondent has no objection to direct the trial Court to decide and dispose the petition filed by the petitioner herein to set aside the exparte order passed the suit, which is now pending on the file of the learned Principal District Munsif, Aruppukottai.

4.In view of the above, the order of arrest that was passed by the Executing Court shall be kept in abeyance till the decision is made in unnumbered petition in S.R.No.5646 of 2023 to set aside the exparte decree. Let the above said petition be disposed of by the trial Court within a period of one month from the date of receipt of a copy of this order, after numbering the same.

5.With the above said direction, this civil revision petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
