ORDER

The petitioner seeks a direction to the 1st respondent to provide Police protection to him from the 3rd respondent, on the basis of his complaint, dated 15.09.2025.

The learned Additional Public Prosecutor, on instructions, would submit that the petitioner is an agreement holder with one Lakshmi; that since the said Lakshmi refused to execute the sale deed as per the sale agreement, the petitioner had filed a suit for specific performance before the Sub Court, Devakkottai, in O.S.No.334 of 2024; that the case is posted for hearing on 26.09.2025; and that since the civil suit is pending, the prayer sought by the petitioner cannot be granted.

3. The learned counsel for the petitioner, however, would submit that the third respondent is no way connected with the said dispute; and that he is threatening the petitioner, forcing him to vacate the premises and to withdraw the suit also.

4. The allegations, primarily, stems out of a civil dispute between the petitioner and the said Lakshmi. The respondents Police cannot interfere in 2/5

such civil disputes. Unless a cognizable offence is made out, the respondents Police would have no right to interfere in such disputes.

5. Hence, this Court is of the view that no direction as prayed for by the petitioner can be issued. It is needless to say that if any cognizable offence is made out, it is open to the respondents Police to take such action in accordance with law.

6. With the above liberty, this Criminal Original Petition is disposed of. 25.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Indu 3/5
