To set aside the Fair and Decreetal order in D.O.P.N.272 of 2023 by the Principal District Judge, Thoothukudi dated 02.03.2024 by dissolving the marriage solemnized in Theresha Church Theresh Puram at Thoothukudi on 27.05.2001 and by allowing this miscellaneous appeal.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.R.IYAPPAN, Advocate for the petitioners, the court made the following order:- This petition is filed to condone the delay of 180 days in filing the appeal in CMA(MD)SR.No.88588 of 2024.
2. The learned Counsel for the petitioners/appellants would submit that the petitioners had filed OP for divorce on mutual consent before the Principal District Judge, Thoothukudi and the same was allowed, vide order, dated 02.03.2024. He further submitted that both the petitioners now want to live together.
3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed on condition to deposit costs of Rs.500/- (Rupees Five Hundred only) to the credit of Cancer Institute (WIA), Gandhi Nagar Canal Bank Road, Adyar, Chennai - 20 (payable in S.B.A/c.No.149710011000002, Andra Bank, Madhya Kailash Branch, Cancer Institute (WIA) Campus, Sardar Patel Road, Chennai - 36, Branch Name and Code:1497, MICR No.600011049, IFSC Code:ANDB0001497) within a period of 15 days from the date of receipt of a copy of 2/3
this order. Failing which, this petition shall stand automatically dismissed without any reference to this Court.
