ORDER

The present writ petition has been filed by a Conductor of the respondent Transport Corporation seeking to dispose of his representation given to the respondents 1 and 2 herein for initiating action against the third respondent, who is a Checking Inspector.

2. According to the learned Counsel appearing for the writ petitioner, the Checking Inspector with mala fide intention is passing on wrong information to the authorities, so that, he has been issued with a memo on two occasions. Hence, he seeks action as against the third respondent.

3. It could be seen from the typed set of papers that every time when the petitioner was found to be defective not only the third respondent but also another Checking Inspector had accompanied him. Therefore, whether the third respondent had acted in mala fide intention or not could be found out only after the enquiry proceedings as against the writ petitioner are completed. Therefore, at this point of time, the respondents 1 and 2 cannot be directed to initiate action as against the third respondent herein. 2/4

4. With the above said observation, this writ petition stands disposed of. There shall be no order as to costs.
