ORDER
[Order of the Court was made by The Hon'ble CHIEF JUSTICE] Application is filed for modification of the stay granted earlier. Stay was against construction of public toilets in the streets leading to the Temple as those toilets once constructed would block free flow of human and vehicular traffic. 2.At the outset, we were not inclined to grant any modification since we were not satisfied with the proposed temporary arrangements suggested for the ensuing Vaikunda Ekadasi festival. However, Learned Additional Advocate General stated that he shall personally look into it and advise the authorities to make temporary arrangements in such a way that even the top most person in the Corporation will be happy to use the facility.
3.After the earlier order was passed, at about 01.15 p.m., Learned Additional Advocate General mentioned the matter in view of the urgency and tendered three photographs of mobile toilets that Corporation wished to deploy during Vaikunda Ekadasi festival beginning from 30.12.2024 and ending on 18.01.2025. The three photographs tendered are taken on record and marked as 'X-1' and 'X-2' respectively. For ease of reference the same are also reproduced now:- 2/7

4.Mr.N.Mujibur Rahman, Regional Director of Municipal Administration, Madurai Region, who is present in Court, assures that hygiene will be maintained and waste collected in these mobile toilets will not leak or flow into the streets, 5/7
instead will be collected in the tanks attached to the mobile units and disposed twice a day. He also assures that the toilets will be maintained clean to ensure that there is no foul smell around the area and further, not later than 19th January 2025, these mobile toilets will be removed from the place. The said statements are accepted as an undertaking to this Court.
5.To this extent, the earlier order of injunction is modified and this petition is ordered.
6.Learned Additional Advocate General states that for the next Chithirai Festival in April, 2025, Corporation will make similar request unless they are able to sort out the matter before.
