ORDER

The petitioner had sent a representation on 07.09.2024 giving details that there is a civil suit pending between the petitioner and the fourth respondent in O.S.No.22 of 2024 before the District Munsif Cout, Virudhunagar, and it is only a civil dispute, on the other hand, the third respondent is harassing the petitioner calling him for enquiry. Hence, this petition.

2. The learned Additional Public Prosecutor appearing for the respondent police, on instructions, would submit that the petitioner earlier lodged a complaint, for which, CSR.No.570 of 2024 assigned on 18.10.2024. Later, the petitioner's complaint was closed. The counter petitioner/fourth respondent had filed a petition before the learned Judicial Magistrate No.II, Virudhunagar, in Crl.M.P.No.884 of 2024 under Section 175(3) of BNSS Act. The learned Magistrate had forwarded the complaint on 08.11.2024 to the third respondent directing to furnish report on or before 09.12.2024. For that purpose only, the petitioner was called. Further submitted that once the petitioner's explanation is received, the same would be recorded and report would be submitted before the concerned Magistrate Court.

3. The learned counsel for the petitioner, on instructions, would submit that the petitioner will appear before the respondent police on 07.01.2025 and give explanation.

4. Recording the same, this Criminal Original Petition is disposed of.
