ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC in Crime No.130 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that on 29.09.2023 during night hours, the defacto complainant's finolex texmo cable wire, worth about Rs.15,000/- was stolen by some persons. Hence, the case.

3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the property was recovered from the petitioner herein and the investigation of this case is not yet completed. 5.Considering the seriousness of the offence committed by the petitioner and considering the fact that the property was recovered from the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
