ORDER
This Criminal Original Petition has been filed to set aside the order made in Crl.M.P.No.7392 of 2023 dated 24.11.2023 and to modify the condition No.I imposed 1/3
in Crl.M.P.No.6765 of 2023 dated 08.11.2023, o the file of the learned Principal Sessions Judge, Thanjavur.
2.The learned counsel appearing for the petitioner would submit that the petitioner is an accused in Cr.No.498 of 2023, which was registered for the offence punishable under Section 147, 379 and 3(1) of TNPPDL Act altered into Sections 147, 148, 379, 506(ii) and 120(b) IPC r/w Section 3(1) of TNPPDL Act and he was arrested. Therefore, he filed bail petition before the Court below and the same was allowed on condition that the petitioner should deposit a sum of Rs.1,56,000/- to the credit of crime number. Thereafter, the petitioner filed a modification petition and the same was also dismissed. Challenging the same, the petitioner preferred the present petition.
3.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that the Court below, after considering all aspects, rightly imposed the condition, which does not warrant any interference by this Court. 4.Considering the facts and circumstances of the case, this Court is not inclined to modify the condition imposed by the Court below. However, the Court below is 2/3
directed not to disperse the amount, which is to be deposited by the petitioner, till the disposal of the case.
