O R D E R This Criminal Original Petition has been filed to withdraw and transfer the investigation in Crime No.171 of 2023 on the file of the third respondent to any other impartial Investigation Agency.

2. It is case of hit and run.

3. The learned counsel appearing for the petitioner submitted that 4 kms from the place of occurrence toll gate is also situated and CCTV camera is also fixed there, for which, the learned Government Advocate(Crl.Side) submitted that they are verifying the CCTV footage and if any new clue is detected they will go on with the further investigation.

4. Let the investigation be completed within a period of five months from the date of receipt of a copy of this order. If the petitioner is aggrieved by the outcome of the final report he can work out his remedy through appropriate proceedings.

4. Therefore at this stage, transfer of investigation would not arise and the petition is liable to be dismissed.
