ORDER

The instant contempt petition has been filed alleging violation of the order of this Court dated 21.12.2022 made in W.P.(MD)No.24837 of 2022, wherein this Court has directed the implementation of the revised pay scale as per the settlement under Section 12(3) of the Industrial Disputes Act. 2.The General Manager of the respondent transport Corporation has filed an affidavit. The relevant portion in paragraph No.4 of the affidavit is extracted as follows:- "However, owing to the financial constrain, this respondent could not settle the amount. As per our calculation, the writ petitioner is entitled for Rs.51,906/- towards gratuity, Rs.30,712/- towards difference in leave salary and I undertake to pay the same in installments. As such, the difference of Gratuity amount was paid thro' ECS on 01.06.2024 & 22.07.2024 respectively. The difference of leave salary of Rs.30,712/- would be paid in 5 Equal Monthly Installments commencing from October 2024 to February 2025 owing to the financial constraints of the corporation."
