PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari calling for the records pertaining to the impugned order passed by the second respondent vide his proceedings in Se.Mu.AA.No.Po.Ni.Pi.3/984/2025 dated 16.05.2025 as against the petitioner herein and quash the same as illegal.

ORDER

This Writ Petition has been filed praying for a writ of Certiorari calling for the records pertaining to the impugned order passed by the second respondent vide his proceedings in Se.Mu.AA.No.Po.Ni.Pi. 3/984/2025 dated 16.05.2025 as against the petitioner herein and quash the same as illegal.

2. The Petitioner has challenged the order of transfer which has been made on administration ground. Even according to the petitioner, she came to the present station in the year 2021, and as such, she has continued at the said station for four years. 2/5

3. This Court is of the opinion that the petitioner has not established any mala fides on the part of the respondents in respect of the transfer made against her. Even the respondents have submitted that only during the transfer period, on administrative grounds, the present transfer was effected.

4. It is also brought on record that the petitioner has not made any request, even though she sought to be retained at the same station on medical grounds. It is also not brought on record that the petitioner made any request seeking consideration of her case for transfer to a nearby place.

5. Considering the facts and circumstances of the case, this Court is of the view that the petitioner shall first comply with the order of transfer and join at the transferred place and on joining report filed by the petitioner, the first respondent is directed to consider the representation of the petitioner as forwarded by the second respondent on merits and in accordance with law within a period of two weeks from the date of submission of the joining report by the petitioner. 3/5

6. With the above directions, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed. 30.10.2025 TTA TO
