PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to reissue/renew the Passport Bearing No. N7518546 to the petitioner by processing his application in File No.MD20755441303725 based on the explanation/representation dated 19.09.2025 within a time limit stipulated by this court. ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent to reissue the passport of the writ petitioner by considering his application dated 19.09.2025.

2. The learned Government Advocate(Crl.side) appearing for the second respondent submits that a criminal case has been registered as against the writ petitioner in Cr.No.148 of 2022 on the file of the second respondent. Investigation is pending and so far, charge sheet has not been laid.

3. This Court in a judgment reported in 2014 (8) MLJ 61 has categorically held that mere pendency of FIR is not a bar for considering the request for reissuance of the passport.

4. In view of the above said facts, the first respondent herein is directed to consider the request of the petitioner for renewal of the passport, if there is no other legal impediment and issue the passport within a period of four weeks from the date of receipt of a copy of this order. 2/4

5. With the above said observations, this writ petition stands disposed of. No costs.
