ORDER
The instant contempt petition has been filed alleging violation of the order of this Court dated 19.03.2020 made in W.P.(MD)No.5730 of 2020, wherein this Court has directed the implementation of the revised pay scale as per the settlement under Section 12(3) of the Industrial Disputes Act. 2.The General Manager of the respondent transport Corporation has filed an affidavit. The relevant portion in paragraph No.4 of the affidavit is extracted as follows:- "However, owing to the financial constrain, this respondent could not settle the amount. As per our calculation, the writ petitioner is entitled for Rs.1,36,710/- towards gratuity, Rs.87,166/- towards difference in leave salary and I undertake to pay the same in installments. As such, a sum of Rs.34,178/- was paid on 25.06.2024 and 12.08.2024. The balance amount would be paid in 5 equal installments commencing from October 2024 to February 2025 owing to the financial constraints of the corporation."
