PETITION FOR CANCELLATION OF BAIL Under Sec.439(ii) Cr.P.C.,/483(3) of BNSS PRAYER :- This Criminal Miscellaneous Petition has been filed under Section 483(3) of BNSS, to cancel the bail granted to the respondent/accused No.5 by this Court in Crl.OP(MD).No.15157 of 2024 dated 10.09.2024.

ORDER : The Court made the following order :- This Criminal Miscellaneous Petition has been filed seeking to cancel the bail granted to the respondent/accused No.5 in Crl.O.P.No. 15157 of 2024 dated 10.09.2024.

2. Notice to the respondent /accused No.5 was served through police since he has committed subsequent murder after obtaining bail.

3. The learned Government Advocate (Crl.Side) submitted that the respondent/accused had already been granted bail by this Court in Crl.OP(MD).No.15157 of 2024 dated 10.09.2024. He further submitted that after his release, he had committed another murder on 20.07.2025. Therefore, the respondent/accused No.5 had been arrested in the said crime. Further, the respondent has not appeared before the trial Court for trial proceedings and violated the conditions imposed by this Court. Hence, he prayed to cancel the bail granted to the respondent/accused No.5.

4. Considering the facts and circumstances of the case and also the fact that the respondent/accused No.5 has violated the condition as imposed by this Court. Hence, this Court is inclined to cancel the bail granted to the respondent/accused No.5.

5. In view of the above, this Criminal Miscellaneous Petition is allowed.
