This Writ Petition is filed for issuance of writ of mandamus 1/5
directing the respondents to issue joint patta in the petitioner's name and the name of his brother Murugan by considering his application dated 13.09.2024 within a stipulated time fixed by this Court.
2. The petitioner and his brother acquired property in S.No. 393/1D1A1 in Senkurichi Village, Dindigul East Tlauk, Dindigul District, under a settlement deed executed by their father on 20.06.2024. According to the petitioner, some persons in the same village were trying to procure separate patta in their names by fabricating the documents and creating encumbrance. The petitioner therefore sent a representation on 13.09.2024 to the respondents to grant patta to him and his brother and also requested the respondents not to make any transaction in respect of the property. The petitioner thereafter submitted an online application for grant of joint patta to him and his brother. As no action was taken, the petitioner filed the above writ petition for the aforesaid relief.

It is seen that the petitioner filed an online application on 02.09.2024, and thereafter submitted a representation on 13.09.2024 to issue a joint patta along with his brother and the said application is kept pending. Therefore, I am inclined to issue a direction to the third respondent to consider the petitioner's representation. Accordingly, the third respondent is directed to consider the petitioner's representation dated 02.09.2024 and pass orders on merits, in accordance with law, in consonance with the provisions of the Patta Passbook Act and also in conformity with the time line issued in the Circular dated 17.07.2023 by the Commissioner, Land Administration, Chennai.
4. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
