O R D E R This Criminal Original Petition is filed to transfer the enquiry from the second respondent to any other investigation agency to further enquiry on the basis of complaints, dated 15.09.2023 and 17.11.2023 on the file of the respondents.

2. Now the grievance of the petitioner is that without conducting proper enquiry, the matter is kept pending before the first respondent.

3. The learned Government Advocate (Crl.side) would submit that the above said enquiry was undertaken on the basis of the complaint given by the petitioner in C.No.88 of 2023. During the course of enquiry, finding that it is a civil issue and a suit in O.S.No.100 of 2023 is also pending, it was closed on 27.11.2023, advising the parties to workout their remedy in the pending suit itself.

4. In view of the above said development, nothing survives for further consideration or direction in this matter. Hence, this matter has become infructuous.

5. With the above said observation, this Criminal Original Petition is dismissed as infructuous.
