The petitioner is accused No.3 in SplSC.No.85 of 2020 on the file of the Mahila Court, Tiruchirappalli District. By judgment dated 11.01.2024 the trial court found the petitioner guilty and sentenced him to undergo 5 years RI and to pay a fine of Rs.4,000/-, in default to undergo 3 months SI for the offence under section 450 IPC; and sentenced to undergo 20 years RI and to pay a fine of Rs.1,00,000/-, in default to undergo 6 months SI for the offence under section 5(g) r/w section 6(1) of POCSO Act; and sentenced to undergo one year RI and to pay a fine of Rs.1,000/-, in default to undergo 1 month SI for the offence under section 506(i) IPC. Challenging the conviction and sentence, the petitioner has filed an appeal in Crl A(MD)240 of 2024 and it has been admitted by this court on 19.03.2024. This criminal miscellaneous petition is filed by the petitioner seeking suspension of sentence.

2.This is the second petition filed to suspend the sentence. This court has elaborately discussed the earlier petition in CrlMP(MD)No.3366 of 2024 filed by the petitioner to suspend the sentence and dismissed the same by order dated 04.09.2024. There is no change in circumstance since the dismissal of the earlier petition. 3.Since typed set of papers is ready, this court is not inclined to entertain this petition. Accordingly, this petition is dismissed with a direction to the Registry to list the main appeal under the caption 'Accused in Jail Cases' during 3rd week of April 2026. 24.03.2026 Index : Yes/No Internet : Yes/No DSK 3/5
