ORDER

The petitioner had lodged the complaint against the third respondent, who is an employee in the Bank stating that by using the 1/4

petitioner's name, the third respondent had misappropriate the loan amount, which was granted to the petitioner's self help ground to the tune of Rs.8,21,600/-.

2.In the earlier the complaint lodged by the petitioner, the third respondent appeared and had given an undertaking to settle the entire amount within a period of three months. Ever after the expiry of the said period, the third respondent has not taken any steps to settle the dues. Further, though the petitioner has informed the Regional Manager and the Manger of the Bank about the misappropriation committed by the third respondent, no action has been taken as against the third respondent. Hence, the petitioner has filed this petition. 3.The learned Additional Public Prosecutor appearing for the respondent police submits that in an earlier occasion both the petitioner and the third respondent agreed to settle the matter amicably and hence, the case was kept at that stage. However, the third respondent had failed to honour his promise and undertaking. Hence, he submits that appropriate steps would be taken as expeditously as possible on the complaint given by the petitioner.

4.In view of the above submission, this Writ Petition is disposed of by directing the respondent Police to conduct proper enquiry on the complaint made by the petitioner. Consequently, connected miscellaneous petition is closed.
