ORDER

This writ petition has been filed for the following relief : "directing the respondents to consider the petitioner application Reference No.200061820625295 dated 26.06.2025 to issue new service connection in Door No.3/30/1, Thirunadampatti Village, Thirumayam Taluk, Pudukkottai District."

2. It is seen that the petitioner had applied for new service connection on 26.06.2025 and he is regularly paying house tax. There is a civil suit pending with regard to Survey No.829/10 in Thirunadanpatti Village, in O.S.No.15 of 2025 on the file of the learned Judicial Magistrate cum Munsif Court, Thirumayam. The application of the petitioner is kept pending without giving any reason. Therefore, the petitioner is before this Court.

3. Heard the learned counsels on either side.

4. There are no prohibitory orders in the suit O.S.No.15 of 2025 on the file of the learned Judicial Magistrate cum Munsif Court, Thirumayam. The grant of connection cannot be denied on the ground of pendency of a suit as stated by the learned Standing Counsel for the respondents. It is well open to the authorities to grant the service connection subject to the result of the suit. In these circumstances, this writ petition is allowed. The respondents 1 and 2 are directed to give the service connection subject to the result of the civil suit in O.S.No.15 of 2025. This Court by passing the aforesaid direction has not expressed any opinion on the title or otherwise of the property.
