ORDER
The order passed by this Court on 01.12.2023 is hereby recalled.
2. This Writ Petition has been filed for issue of Writ of Mandamus directing the respondent police to remove the name of the petitioner from the history sheet maintained by the 3rd respondent in H.S.No.4 of 2022.
3. Heard Mr.K.C.Maniyarasu, learned counsel for the petitioner and Mr.A.Albert James, learned Government Advocate (Criminal Side) appearing for the respondents.
4. The learned Government Advocate (Criminal Side) submitted that presently, the history sheet is pending before the 3rd respondent police in H.S.No.22 of 2024 dated 16.03.2024.
5. Taking into consideration the facts and circumstances of the case, and also considering the nature of the relief sought for by the petitioner, 2/5
there shall be a direction to the petitioner to submit a fresh representation before the 3rd respondent requesting for removal of his name from the history sheet in H.S.No.22 of 2024. On receipt of the same, the 3rd respondent shall deal with it in line with the guidelines issued by this Court in Sabari @ Sabarigiri Vs. Assistant Commissioner of Police, Annanagar (L and O) Range, Madurai City, Madurai and others [(2018) 4 MLJ (Crl.) 585] and pass appropriate orders within a period of six weeks thereafter.
6. Accordingly, this Writ Petition is disposed of with the above direction. No costs.
