Heard both sides.
2. The petitioner is holding Passport. He has been asked to surrender the same in view of the implication in a criminal case. The criminal case is subsequent in point of time.
3. It is seen that the case is rather political in nature. It is still pending only at the FIR stage. Therefore, the question of having surrendered the passport does not arise. The impugned communication is set aside. This writ petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed.
