ORDER

This contempt petition is filed in respect of the order dated 18.03.2022 made in W.P(MD)No.16561 of 2020. The operative portion of the order reads as follows:

"4. In such view of the matter, the Investigation Officer is directed to investigate the matter thoroughly and find out as to the involvement of the driver of the lorry. If the investigation discloses the involvement of the lorry driver referred to in the writ petition, the Investigation Officer shall proceed against the accused."

2. When the matter was taken up for hearing, the contemnor was present, and a status report was filed by her, wherein it has been stated as follows:

"5..........(b) I humbly submit that the owner of the vehicle namely, Ayyadurai, owner of Sri Sakthi Murugan Body works namely Rajagopal and Indian Auto Diesel Works owner namely, Annadurai were enquired and it was found that the lorry bearing registration No.TN 69 AB 7407 was in Namakkal for vehicle repair for FC from 24.02.2019 to 15.05.2019.

(c) I humbly submit that it was also revealed during enquiry that the witnesses brought by the petitioner are her close relatives.

(d) I respectfully submit that despite of our best efforts, we could not trace the vehicle involved in the accident. Eye witnesses namely Sivanesan, Balasundar, Thangavel, Palanivel and Aravindhan could not provide any information about the vehicle involved. Hence, the petitioner was served an RCS notice in No.01/2014 and a final report was filed as "Un-Detected" dated 05.01.2024.

(e) I humbly submit that there was no disobedience or non-compliance of the order of this Honourable court. With utmost sincerity, I discharged my duty and despite my best efforts, the vehicle could not be traced. During investigation, it was found that the lorry bearing registration No.TN 69 AB 7407 was not involved. Hence, the final report was filed as "un-detected....."

3. In view of the above, it is seen that the Investigating Officer has duly performed her duty and submitted a report stating that the vehicle bearing Registration No. TN 69 AB 7407 was not involved. Therefore, this contempt petition stands closed. The appearance of the contemnor is dispensed with. No costs.
