ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) WMP(MD)No.20880 of 2025 has been filed to implead the petitioner herein as 6th respondent in the main writ petition.

2. It is submitted by Mr.K.Ganesan, learned counsel for the petitioner herein that he is also the counsel for the 5th respondent in the 2/5

main writ petition which is a Society in the name of Sri Vaikuntapathy Perumal Thirupani Kaingarya Trust. Though the 5th respondent in the main writ petition is one of the parties where the present petitioner to get impleaded, is a member, the actual case on behalf of the 5th respondent in the main writ petition has not been projected effectively. Therefore, the present petitioner being one of the members wants to get impleaded in the main writ petition to project the grievance on behalf of the members that is the purpose for which the present impleading petition has been filed.

3. We are not impressed with the said submission made by the learned counsel for the petitioner for the simple reason that if at all the interest of the present petitioner is to be taken care of, it must have been or it should be taken care of by the 5th respondent in the main writ petition and if the 5th respondent is not effectively pursuing the case on their behalf, the grievance of the petitioner is something different where the forum is elsewhere, for which, the impleading by himself as one of the party respondents in the main writ petition is not a remedy. In that view of the matter, we are not inclined to entertain this petition. Hence, 3/5

it is liable to be dismissed and accordingly dismissed. However, the dismissal of this writ petition will not preclude the 5th respondent in the main writ petition to effectively pursue their case by filing a detailed counter on their behalf in the main writ petition.
