PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st to 3rd respondents to cancel the patta Nos.1061 and 1063 of 2025 dated 05-05-2025 issued by the 3rd respondent that was made out by the 5th and 9th respondent to their legal heirs. ORDER

After submitting notice dated 02.09.2025 seeking cancellation of the patta issued to the private respondents herein, the present writ petition has been filed. 2.Learned Government Advocate accepts notice for respondents 1 to 4. He submits that the petitioner has not made a proper appeal or representation for cancellation of the patta. If such appeal were to be presented, he submits that the same would be disposed of on merits by the Revenue Divisional Officer within four months from the date of receipt thereof. 3.In view of the nature of relief claimed and the submissions of learned Government Advocate, it is not necessary to issue notice to the private 2/4

respondents herein. Instead, this writ petition is disposed of on the following terms:- a)The petitioner is directed to submit an appeal before the Revenue Divisional Officer within two weeks from the date of receipt of a copy of this order; and b)Upon receipt thereof, the Revenue Divisional Officer is directed to consider and dispose of the same on merits after providing a reasonable opportunity to all parties thereto, including the private respondents herein. Such speaking order shall be issued within four months from the date of receipt thereof. No costs.
