ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 420, 465, 467, 468, 471, 474 and 120(B) of IPC, 1860, in Crime No.20 of 2024, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that in the year 1988, the defacto complainant purchased a plot in No.308 in Sri Kamatchi Amman Nagar in Resurvey No.212/3, Sirtur Village, Madurai North Taluk, Madurai. He used to visit his plot whenever he came to Madurai. Subsequently he decided to construct a house to his only son and thus on 18.04.2024 the defacto complainant came to his plot for cleaning work. At that time, he shocked to find that some other persons cleaned his plot and started construction. Immediately he verified the encumbrance and found that all the accused persons including this petitioner have conspired among them and created a forged document as if the defacto complainant and his wife died earlier and obtained patta in the name of 1st accused. In-turn the 1st accused had executed a general power of attorney deed in favour of this petitioner on 20.11.2023 in document No.7280/2023. Inturn this petitioner executed a sale deed in favour of accused Nos.3 & 4 in document No.7330/2023. The accused Nos.5 & 6 have attested as a witness in 2/6
the general power of attorney deed executed in favour of 2nd accused. The accused Nos.7 & 8 also attested witness in the document executed in favour of 3rd and 4th accused. The remaining accused are document writers. All the accused conspired among them and executed the defacto complainant's property with intent to cheat him. Hence, a case has been registered as against the petitioner.
3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature. Further, the petitioner is the witness in the alleged forged documents. 5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail in the 3/6
event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Learned Judicial Magistrate No I, Madurai, within a period of fifteen days from the date on which the order copy made ready and on further conditions that: [a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders.
[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.
[d]the petitioner shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f]If the accused thereafter absconds, a fresh FIR can be registered under 4/6
Section 269 of BNS.
