Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorari, to call for the order passed in Na.Ka.No. 3543/A1/2021 dated 15.07.2022, passed by the 1st respondent herein and to quash the same as illegal.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the order dated 15.07.2022, passed by the 1st respondent. https://www.mhc.tn.gov.in/judis

2.The impugned order is passed under Section 77(A). The official respondents have elaborately dealt with and conducted a regular civil proceeding and granted share to the parties which is astonishing. The same is passed without jurisdiction. Therefore, impugned order is quashed. Already a civil suit is pending between the parties in O.S.No.230 of 2021 on the file of Sub Court, Devakottai. The parties are at the liberty to adjudicate their rights in the pending suit. 3.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
