custody on 23.09.2024 for the offences punishable under section 417, 376 and 506(i) of IPC, in Crime No.28 of 2024, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner had love affair with the defacto complainant and on false promise to marry her the petitioner had physical relationship with the defacto complainant, due to which she became pregnant and later the petitioner evaded the defacto complainant. Hence, the case.
3. The learned counsel appearing for the petitioner would submit hat the defacto complainant has lodged a false complaint against the petitioner and based on the same a case has been registered in Crime No.28 of 2024 for the offences under Sections 417,376 and 506(i) of IPC. The petitioner has not committed any offence as alleged by the prosecution. He was arrested and remanded to judicial custody on 23.09.2024 and thereafter interim bail was granted to him and he was directed to appear before the mediation centre and the matter has been mediated but the victim girl refused to marry the petitioner. The petitioner is also ready to marry the defacto complainant. Aalready a male child was born to them and now the child is under the care and custody of the Child Welfare Committee. However the defacto complainant refused to marry the petitioner, therefore prayed to grant bail to the petitioner. 2/4
4. The learned Government Advocate(Crl.Side) appearing for the respondent police would submit that already this Court has granted interim bail to the petitioner and thereafter referred the matter to mediation. Now the investigation is almost completed and awaiting for DNA report.
5. Considering the rival submissions made on either side and the petitioner was already granted interim bail by this Court and also the matter was referred to mediation and also no any amicable settlement arrived at between the parties and also investigation is almost completed and only awaiting for DNA report, this Court is inclined to grant bail to the petitioner.
6.
