To admit this appeal on file, to call for the records from the lower Court in S.C.No.83/2018 on the file of the Learned Additional District & Sessions Judge, Dindigul, Dindigul District and set aside the judgment dated 09.10.2023 by acquitting the appellant and by allowing the Appeal.

Prayer in CRL MP(MD). 17413/ 2023 :

To suspend the sentence imposed on the petitioners/appellants/Accused No.1 and 2 in SC.No.83/2018 dated 09.10.2023 on the file of the learned Additional District and Sessions Judge, Dindigul enlarge them on bail till the disposal of the appeal Prayer in CRL A(MD). 1094/ 2023 :

To call for the records relating to the judgment passed in S.C.No.83/2018 dated 09.10.2023 on the file of the learned Additional District and Sessions Judge, Dindigul and set aside the same and acquit the Appellants/Accused No.1 & 2 from all the charges levelled against them.

Order : These Criminal Miscellaneous Petitions coming up for orders on this day, upon perusing the petitions filed in support thereof and upon hearing the arguments of MR.K. PRABHU, Advocate for the petitioner in CRL MP(MD)No.17346 of 2023 and MR.S.G.L.RISHWANTH, Advocate for the Petitioners in CRL MP(MD)No.17413 of 2023 and of MR.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor on behalf of the Respondent in both cases, the court made the following order:- [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] When this Court was about to dismiss the miscellaneous petitions on merits, respective learned counsel appearing for the respective petitioners sought permission of this Court to withdraw the same and they have also made endorsements to that effect.
