O R D E R

The petitioner, an accused in Spl.S.C.No.177 of 2024, on the file of the Sessions Judge, Fast Track Mahila Court, Dindigul was found guilty by the trial Court and was convicted and sentenced as under:- Sl.No Sections Punishment Fine amount Default 366 IPC 7 years Rigorous imprisonment Rs.2,000/- 3 months simple imprisonment Section 6 of POCSO Act, 2012 20 years Rigorous Imprisonment Rs.3,000/- 6 months simple imprisonment As against the conviction and sentence imposed by the trial Court in Spl.S.C.No.177 of 2024, dated 24.06.2025, the petitioner has filed a Criminal Appeal in Crl.A(MD)No.1116 of 2025 and the same was admitted by this Court on 22.10.2025. The petitioner has also moved this application to suspend the sentence imposed on him by the trial Court. This Court while entertaining this application on 03.02.2026, granted an interim suspension of sentence for this petitioner for a period of four weeks till 02.03.2026 on the undertaking of this petitioner and the willingness expressed by the victim girl to marry the petitioner. 2/5

2. When this application is taken up for hearing today, it is reported that the petitioner had married the victim girl and the marriage has also been registered. Taking into consideration of this development, this Court is inclined to suspend the sentence imposed on the petitioner.

3. Accordingly, the substantive sentence of imprisonment alone is suspended pending disposal of the criminal appeal and the petitioner is ordered to be enlarged on bail on the following conditions:- i. The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Fast Track Mahila Court, Dindigul, out of which, one surety must be the petitioner's wife.

ii. The petitioner shall report before the learned Sessions Judge, Fast Track Mahila Court, Dindigul, on the first working day of every English Calender month at 10.30 a.m., till the disposal of the appeal.
