PRAYER: Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, to call for the records pertaining to the proceedings in D.V.C.No.45 of 2013 pending on the file of the Judicial Magistrate No.2, Thanjavur as far as the petitioner is concerned and quash the same in so far as the petitioner is concerned.

The petitioners have filed this Criminal Original Petition for quashing the proceedings initiated by the respondent, under the provisions of Protection of Women from Domestic Violence Act, 2005. 2.The contentions raised in this petition have to be necessarily adjudicated only during the regular proceedings. In such cases, this Court cannot exercise the inherent powers, under Section 482 Cr.P.C., 3.Therefore, this Criminal Original Petition is dismissed. However, the petitioners need not appear for every hearing. They can be represented through their counsel. The learned trial Magistrate shall insist for the appearance of the petitioners, only when it is absolutely necessary and imperative. The relief of dispensing with the personal appearance alone, is granted in this case. Consequently, connected Miscellaneous Petitions are closed.
