ORDER : The Court made the following order :- The petitioner / Accused No.4, who was arrested and remanded to judicial custody on 05.11.2024 for offences under Sections 8(c), 20(b)(ii)(C), 29(1) ad 25 of NDPS Act, 1985 in Crime No.98 of 2024 on the file of the respondent Police, seeks bail.

2. In the instant case, there are totally five accused persons and the petitioner has been arrayed as Accused No.4. The allegation against Accused No.4 is that he was in touch with the other accused persons and they were planning to smuggle the contraband to Srilanka. In the instant case, initially, 30 kgs of ganja was seized from Accused No.1, subsequently, 20 kgs of ganja was seized from Accused No.2 and 1.500 kgs of ganja was seized from the petitioner. The material that is now put against the petitioner is that he had made phone calls to Accused No.2 from his mobile phone for nearly 33 times during the relevant point of time. That apart, the police is also relying upon the confession of the co-accused.
3. In view of the above, this Court does not find any ground to enlarge the petitioner on bail at this stage. This is more so considering the previous antecedents of the petitioner. Hence, the petitioner will have to await for the completion of the investigation in this case and after filing of the police report along with the relevant materials, it is left open to the petitioner to revive his claim for bail.
