ORDER
This Criminal Original Petition is filed to quash the impugned final report in Spl.S.C.No.26 of 2020 on the file of the Additional District and Sessions Court for the Exclusive Trial of PCR Act Cases, Sivagangai, Sivagangai District, which was filed for the offences under Sections 294(b), 109, 307 of the IPC r/w. Sections 3(1)(r) and 3(1)(s) of the SC/ST (Prevention of Atrocities) Act, 1989.
2. The allegation in the final report is that, on account of prior enmity, the petitioners attacked the de-facto complainant with a knife, caused an injury to her stomach, and abused her in filthy language by humiliating her on account of her caste.
3. The learned counsel for the petitioners would submit that the victim/ de-facto complaint himself does not wish to pursue the proceedings any further, 2/6
and the parties have now arrived at a compromise and have also filed a joint compromise memo dated 08.10.2025.

The learned Government Advocate (Criminal Side), on instructions, would submit that the de-facto complainant had received a sum of Rs.1,50,000/- (Rupees One Lakh and Fifty Thousand only) as compensation from the Adi Dravidar and Tribal Welfare Department, and that a direction may be issued to the de-facto complainant to deposit the said amount to the said Department.

The petitioners, namely Selvam @ Selvarajan (Aadhaar No.8369 5798 5237), Nagarajan (Aadhaar No.8544 0976 9649), Muthuramu (Aadhaar No. 9459 3505 8330), and Muthammal (Aadhaar No.4330 0905 8781), are present before this Court in person, and the de-facto complainant/3rd respondent, namely Vairamuthu (Aadhaar No.7753 3819 9576), is present through Video Conference. They are identified by Mr.C.Tamilselvam, Special Sub Inspector of Police, Kandavarayanpatti Police Station, Sivagangai District. All the parties confirmed the compromise arrived at between them, and the de-facto complainant/3rd respondent has stated that she does not wish to pursue the proceedings any further.

In the present case, though the petitioners are charged for the offence under Section 307 of the IPC, it is seen that the occurrence took place during a sudden fight pursuant to a wordy altercation. Considering the nature of the injuries, this Court is of the view that the act of the 1st petitioner would at best attract the offence under Section 326 of the IPC.

In view of the above, and considering the nature of the allegations against the petitioners and the relationship between the parties, and in view of the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in Spl.S.C.No.26 of 2020 on the file of the Additional District and Sessions Court for the Exclusive Trial of PCR Act Cases, Sivagangai, Sivagangai District, is quashed and this Criminal Original Petition stands allowed. The petitioners shall pay a sum of Rs.15,000/- (Rupees Fifteen Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The de-facto complainant shall deposit the sum of Rs.1,50,000/- (Rupees One Lakh and Fifty Thousand only) to the Adi Dravidar and Tribal Welfare Department 4/6
within a period of four weeks from the date of receipt of a copy of this order, failing which, the order passed by this Court shall stand vacated without any further reference to this Court. The joint compromise memo dated 08.10.2025 shall form part of this order.
