ORDER

The petitioner belongs to Scheduled Caste community. Seeking issuance of free house site patta, he filed WP(MD)No. 16277 of 2024. I directed Tahsildar, Kariyapatti to dispose of the petitioner's representation within a certain time frame. The direction was given on 22.07.2024. Pursuant to the said direction, the Tahsildar, Kariyapatti sent proposal dated 26.10.2024 to the Revenue Divisional Officer, Aruppukottai. It appears that patta in respect of the land on which the petitioner's staked claim was in the name of one Thangaraj. The Tahsildar, Kariapatti recommended cancellation of the patta. In the meanwhile, this Contempt Petition came to be filed in December 2024. May be as a knee jerk reaction, the Tahsildar, Kariapatti passed an order dated 12.02.2025 rejecting the petitioner's request on the ground that mutation has already been made in favour of Thangaraj.

2.In the interest of justice, I set aside the order dated 12.02.2025 passed by the Tahsildar, Karipatti in Na.Ka.No.A6/2340/2024. Since the RDO, Aruppukottai is now seized of the matter, I direct the RDO, Aruppukottai to pass 2/16

appropriate order based on the proposal dated 26.10.2024 submitted by the Tahsildar, Kariapatti. The petitioner is given liberty to submit a fresh representation and if the RDO is satisfied about the genuineness of the petitioner's claim, he can issue appropriate direction to the Tahsildar in favour of the petitioner herein.

3.This contempt petition is disposed of.
