ORDER
This writ petition has been filed for a mandamus to direct the 1st respondent to register the petitioner's educational agency in JRS Higher Secondary School, Kothaiyam, Ottanchathiram Taluk, Dindigul District as per the petitioner's application dated 25.10.2018 and 01.09.2025.
2. Mrs.D.Farjana Ghoushia, learned Special Government Pleader takes notice on behalf of the respondents.
3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.
4. The facts as set out in the affidavit filed in support of the writ petition reads as follows:- 2/6
The petitioner would submit that he is the Correspondent of the JRC High School, which is a Government Aided School. The said school was originally founded by 'Yehovah Seerthirutha Sabai' along with the petitioner and his family members on 07.02.1990. He would submit that he was appointed as a Correspondent on 15.06.2003, based on the resolution of the management and the same was also approved by the respondent office. Thereafter, the said school was upgraded as Higher Secondary School in the year 2003-2004 and his correspondence was transferred and registered by the 3rd respondent on 30.06.2003. The Government has also appointed teachers from various schools as there is a steep increase in the students enrollment.
5. He would submit that since the 'Yehovah Seerthirutha Sabai' was not able to run the school, the school management was transferred from the said 'Yehovah Seerthirutha Sabai' to Jayaram charitable Trust headed by the petitioner and others.

6. He would submit that he along with others had submitted an application for transfer of management before the 2nd respondent office and the same was also forwarded to the file of the 1st respondent on 31.10.2008. However, no steps had been taken.

He would further submit that once again he submitted an application before the 1st respondent through the 2nd respondent on 16.09.2013 and on 12.01.2016, the 3rd respondent has sent a proposal to the 1st respondent. Thereafter, the 1st respondent sought for building stability certificate, possession certificate, fire service certificate and other allied documents on 13.09.2018 and the has also been submitted on 25.10.2018. However, no steps had been taken.

That apart, he would submit that on 23.01.2025 and on 20.03.2025, he was directed to submit the certificate of separate management from the 1st respondent, however, the 1st respondent has not passed any order to transfer the management as well as the registration of separate management. Aggrieved by the same, the petitioner is before this Court.

9. Per contra, the learned counsel appearing for the respondents would submit that the application is now pending before the 2nd respondent, who has to forward it to the 1st respondent.

In view of the above, the 2nd respondent is directed to ensure that the papers are forwarded to the 1st respondent within a period of one week from the date of receipt of a copy of this order, if the application is in order. On receipt of the same, the 1st respondent shall consider the application of the petitioner dated 25.10.2018 and 01.09.2025 and pass final orders on merits and in accordance with law within a period of two months therefrom.
11. The writ petition stands disposed of with the above directions. No costs.
