PRAYER :- For Anticipatory Bail in Crime No. 65 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 406 and 498-A of IPC, in Crime No.65 of 2024 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant married A1 on 22.10.2022. There was some misunderstanding between A1 and the defacto complainant and already proceedings have been initiated under the Domestic Violence Act and the same is pending before the competent Court. That apart, A1 had also initiated proceedings for dissolution of marriage and the same is also pending before the Family Court. It is under these circumstance, the defacto complainant has given a complainant to the police to the effect that she was treated with cruelty and harassed by the accused persons and that her jewelry is being retained by the accused persons and not returned back.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. Taking into consideration the facts and circumstances of the case and considering the fact that there is a matrimonial dispute involved in this case and there 2/4

are pending proceedings between the parties, there shall be a direction to the respondent police to adopt the procedure adumbrated under Section 35 of BNSS and complete the investigation as expeditiously as possible.
