ORDER
This Civil Revision Petition has been filed seeking a direction to dispose the Interlocutory application in I.A.No.01 of 2024 in O.S.No.245 of 2024 pending on the file of the learned II Additional District Munsif, Madurai Town within a time stipulated by this Court.
2. According to the revision petitioner, the petitioner is running a club in the suit property in the name of Green sports and Recreation Club with all necessary licenses. The petitioner is running the aforesaid Club in a very peaceful manner. However, there is civil dispute between respondents 1, 2 and 3 which is pending before the various Courts. In the meantime, the petitioner filed a civil suit before the learned II Additional District Munsif, Madurai Town in O.S.No.245 of 2024 praying for a permanent injunction of the respondents herein to restrain them from the peaceful possession of the suit property. It is pertinent to mention that the petitioner had filed an interlocutory application praying for an ex parte 2/5
ad interim injunction and the same was numbered as I.A.No.01 of 2024. But unfortunately as on today even after issuing notice to the respondents, the aforesaid interlocutory application is pending without any progress. Hence, the present Civil Revision Petition is filed.
3. Heard the learned counsel appearing for petitioner. Since the revision is filed for seeking early disposal, no notice is necessary to the respondent.
4. Having been taken into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, a direction may be issued to the learned II Additional District Munsif, Madurai Town, to dispose of the case as expeditiously as possible.
5. Accordingly, this Civil Revision Petition stands disposed of with a direction to the learned II Additional District Munsif, Madurai Town to dispose of the Interlocutory application in I.A.No.01 of 2024 in O.S.No.245 of 2024 pending on his file, within a period of one (1) month 3/5
from the date of receipt of a copy of this order on merits and in accordance with law. There shall be no order as to costs. 18.12.2024 NCC : Yes / No Index : Yes / No Internet : Yes BTR To The II Additional District Munsif, Madurai Town.
