O R D E R

The petitioner has come forward with this petition seeking for a direction, directing the respondents to take effective steps to secure the absconding accused viz., Vishnu and Renganathan, in connection with the case in Crime No.227 of 2013, registered for the offences punishable under Sections 406, 420, 465, 468 and 471 of IPC., on the file of Kallikudi Police Station. https://hcservices.ecourts.gov.in/hcservices/

2. Mr.G.Mariappan, the learned counsel appearing for the petitioner would submit that the accused has collected the amount of Rs.2,50,00,000/-, by creating forged Railway appointment orders, from the various persons. Based on the complaint, though the respondent police has registered the case in Crime No.227 of 2013 for the above said offences, the respondent police has not taken any steps to arrest the accused and recover the amount so far.

3. I have heard Mr.G.Mariappan, learned counsel appearing for the petitioner and Mr.K.Anbarasan, learned Government Advocate (crl.side) for the State. I have also perused the materials available on record.

4. The respondent Police has filed a Status Report stating that a Special Team has been constituted on 11.06.2014 for completing the investigation as expeditiously as possible and to file a final report before 25.06.2014. It is further averred in the status report that the said Vishnu now is in abroad and therefore, Look Out Circular Notice has been issued against him. Further, already 22 witnesses have been examined so far and their statements under Section 161(3) of Cr.P.C., were recorded.

5. It could be deduced from the records and submissions that the said Vishnu alone involved in the commission of offence and he is now in abroad. Look Out Circular Notice has been issued against the accused and the respondents have taken effective steps to secure the accused. In such circumstances, the respondent police is directed to secure the accused Vishnu and to file the final report as expeditiously as possible.

6. With the above direction, this Criminal Original Petition is disposed of.
