Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the official respondents.

2.The petitioner impeaches the validity of the petition mentioned document that was executed in the year 2016. The third respondent declined to interfere in the matter and called upon the petitioner to pursue her remedy in the civil Court.

3.It is seen that the petitioner filed partition suit against the private respondents in O.S.No.489 of 2017 on the file of the Sub Court, Thirumangalam (originally O.S.No.208 of 2013). The petitioner appears to have obtained exparte decree. If that be so, the remedy open to the petitioner is to enforce the same. Since the petition mentioned document was executed during the pendency of the suit, it is subject to the rights of the petitioner in the suit. Granting liberty to the petitioner to enforce the decree said to have been obtained in her favour, this writ petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
