ORDER

The petitioners sought for quashing of the impugned final report in S.C.No.189 of 2025 on the file of the learned Additional District Judge, Kumbakonam, Thanjavur District, registered for the alleged offences under Sections 294(b), 324 and 307 I.P.C.

2. The gist of the allegation in the final report is that on account of prior enmity, the petitioners had attacked defacto complainant and three witnesses with iron rod and abused them in filthy language and thus committed the aforesaid offences.

3. The learned counsel for the petitioners would submit that the dispute is private in nature and the parties have arrived at a compromise; and that though the petitioners have been charged for the offence under Section 307 I.P.C., the doctor had opined that the injuries suffered by the 2/6

victims and the defacto complainant are simple in nature and also produced the extract of the Accident Register in respect of the three victims, which confirms that the victims had sustained only simple injuries. Both the parties have agreed that the impugned final report may be quashed.

4. The parties have also filed a joint compromise memo dated 09.10.2025. The petitioners and the respondents 3 and 5 are present before this Court in person. The defacto complainant, who is in custody, in connection with another case, appeared through Video Conferencing and one Vasanthkumar, one of the victims, is also appeared through Video Conferencing. They are identified by Mr.C.Kulanthaivelu, S.I., Nachiyarkoil Police Station, Thanjavur District. Both the parties confirmed the compromise arrived at between them.

6. Though the allegation is for an offence under Section 307 I.P.C, as rightly pointed out by the learned counsel and the learned Additional Public Prosecutor, the injuries suffered by the victims and the defacto complainant are a simple injury and therefore, do not suggest the 3/6

commission of an offence under Section 307 I.P.C.

Considering the above, the nature of allegations, the fact that the dispute is private in nature and since the parties have now arrived at a compromise, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending investigation. Accordingly, the impugned final report in S.C.No.189 of 2025 on the file of the learned Additional District Judge, Kumbakonam, Thanjavur District, is hereby quashed. The joint compromise memo dated 09.10.2025, shall form part and parcel of the order.
