Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to forbear the 4th respondent from laying huge drinking water pipeline under AMRUT Scheme through the streets of petitioner's residence in S.No.119/48 situated at Mahaganapathy Nagar, Velalar Street, Power House, Paravai II-bit, Paravai Town Panchayat, Madurai North Taluk, Madurai District, within the time frame stipulated by this Court.

[Order of the Court was made by M.SUNDAR, J.] When the captioned Writ Petition [hereinafter 'WP' for the sake of brevity] was taken up, it came to light that the WP petitioner is not espousing a public cause but is seeking a prayer with regard to his residence.

Faced with the above situation, Mr.R.V.Vetrivel, learned counsel representing the counsel on record for petitioner sought leave of this Court to withdraw the captioned writ petition but made a plea to preserve all the rights and contentions of the WP petitioner to move the appropriate Court / Courts / Forum / Fora / Authority / Authorities with a suitable prayer.

In the light the narrative thus far, captioned WP is disposed of as closed / withdrawn albeit with the observation that the rights and contentions of the WP petitioner are preserved to move appropriate Court / Courts / Forum / Fora / Authority / Authorities with a suitable prayer. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
