ORDER

The petitioner seeks a direction to the learned Judicial Magistrate No.II, Pudukottai District to consider the warrant recall application to be filed by the petitioner on the same day of its filing on their surrendering in connection with the case in C.C.No.32 of 2019.

2. The petitioner, who is facing trial for the offences punishable under Sections 406 & 420 of IPC. It is seen that the learned Judicial Magistrate No.II, Pudukottai District had issued a Non Bailable Warrant against the petitioner on 19.01.2023. According to the petitioner, he was not aware of the pendency of Non Bailable Warrant as he was working abroad.

3. Without going into the merits of the claim made by the petitioner, the learned Judicial Magistrate No.II, Pudukottai District is hereby directed to consider the petitioner's application in accordance with law and on its own merits on the same day of his surrender.

4. With the above direction, this Criminal Original Petition is disposed of.
