PRAYER: Criminal Original Petition is filed under Section 439(1)(b) read with 528 of BNSS Act, to modify the condition No.II made in Cr.M.P.No.8430 of 2024, dated 27.11.2024, on the file of the learned Principal Sessions Judge, Tirunelveli imposed on the petitioner. For Petitioner : Mr.C.Rathna Vel Pandian For Respondent : Mr.A.Albert James, Government Advocate (Criminal Side) O RDER This Criminal Original Petition has been filed to modify the condition No.II imposed in Cr.M.P.No.8430 of 2024 dated 27.11.2024 by the learned Principal Sessions Judge, Tirunelveli. 1/4

2. The petitioner is aggrieved by condition No.II, whereby, the petitioner was directed to deposit a sum of Rs.3,00,000/- (Rupees Three Lakhs only) before the learned Judicial Magistrate No.I, Tirunelveli. It is seen from the records that the husband was also arrested in this case, and when he was granted bail, there was a direction to deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs only). Accordingly, this amount has been deposited.

3. Considering the fact that the amount involved in this case is a sum of Rs.2,45,000/- (Rupees Two Lakhs and Forty Five Thousand only) and 54 grams of gold, the condition No.II imposed by the Court below is modified as follows :

"ii. The petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) before the Judicial Magistrate No.I, Tirunelveli within a period of four weeks from the date of release on bail."

4. All other conditions shall remain as it is. 2/4

5. This Criminal Original Petition is disposed of in the above terms.
