PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to issue a direction to transfer the enquiry of the Petitioner's complaint dated 12.04.2022 pending on the file of the 2nd Respondent in proceedings No.G5E4760157/1996/23 to any other competent authority to conduct further enquiry. 1/4

ORDER

This criminal original petition has been filed seeking direction to transfer the enquiry of the Petitioner's complaint dated 12.04.2022 pending on the file of the 2nd Respondent in proceedings No.G5E4760157/1996/23 to any other competent authority to conduct further enquiry.

2.On the side of the petitioner it is submitted that during the course of enquiry earlier the private respondents also appeared before the second respondent and gave an undertaking that they will settle the issue. But, did not do so. Thereafter only the present complaint has been lodged.

3.The learned Additional Public Prosecutor would submit that within a week, the enquiry will be completed and further action will be taken depending upon the outcome of the enquiry. There is no question of transfer of enquiry at this stage.
