ORDER

Heard both sides.

2.The petitioner and his siblings entered into a partition deed. It was reduced into writing vide document dated 11.09.2025. The said partition deed was presented for registration. Citing the bar under Section 22A of the Registration Act, 1908 registration was refused. Challenging the same, this writ petition has been filed. 3.The property originally belonged to one Ponnan, who is none other than the grandfather of the writ petitioner. Following his demise, the property devolved upon Muthan, father of the petitioner. Muthan had also passed away. Thereafter, the legal heirs entered into a partition among themselves. In fact, the patta is a joint one and it reflects the names of all the 4 parties to the document. I had a look at the schedule. There is no creation of any pathway. The property continues to retain its character as agricultural land. The parties have agreed not to undertake any development on the land without getting permission from the competent authority.

4.Recording the said undertaking, the impugned refusal check slip is quashed. The parties are permitted to re-present the document. It shall be registered and released subject to the fulfilment of the other usual formalities. The registering authority is directed to register this order passed by this Court.
