ORDER : The Court Made the following order :- The petitioner is the sole accused and he was arrested and remanded to judicial custody on 16.11.2013 by the respondent police for the alleged commission of offence under Sections 8(c) read with 20-(b)(ii) B of N.D.P.S. Act, in Crime No.345 of 2013 on the file of the respondent police, and hence seeks bail.

2.The case of the prosecution is that on 16.11.2013, the respondent conducted a raid and the petitioner was found in possession of 1.250 kgs of kanja without any valid licence or permit. 3.The learned counsel appearing for the petitioner would submit that the petitioner is a lady aged about 65 years and purely for statistical purposes, she has been falsely implicated in this case. 4.The learned Government Advocate (criminal side) would submit that the petitioner is involved in 10 previous cases in crime Nos.561/2008, 539/2009, 1198/2009, 565/2011, 87/2012, 213/2012, 398/2012, 52/2013 and 39 of 2012 and strongly oppose the application for bail. 5.

This Court, taking into consideration of the period already undergone by the petitioner/lady, who is aged about 65 years and further considering the fact that seized contraband is very much less than the commercial quantity, is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioner is directed to be released on bail each of them on executing a personal bond each for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District Judge/Principal Special Court for E.C. and N.D.P.S. Act Cases, Madurai and https://hcservices.ecourts.gov.

on further condition that the petitioner shall appear before the respondent police daily at 11.00 a.m for a period of four weeks and thereafter, as and when required.
