ORDER

This Criminal Original Petition is filed to direct the respondents to conduct further investigation in the case in Crime No.134/2020 on the file of 2nd respondent police.

2. It is a case, case in counter. The grievance of the petitioner is that without properly conducting investigation as per the settled procedure, final report was filed in the counter complaint in C.C.No.73 of 2022. But the complaint of the petitioner was closed as mistake of fact. According to him, no proper investigation was conducted.

3. Learned Government Advocate submitted that RCS notice was served upon the petitioner. It is further submitted that the petitioner has filed protection petition against the closure report. Now trial is conducted by the learned Judicial Magistrate, Singampunari. Simultaneously, this petition came to be filed, which is not maintainable. 2/4

4. In view of the submission, the petitioner has to work out remedy before the trial Court and this petition has been filed unnecessarily. Accordingly, this Criminal Original Petition is dismissed. 07.12.2023 NCC :
