ORDER
This Writ Petition had been filed to quash the impugned order passed by the fourth respondent, dated 16.03.2019 and the consequential impugned order passed by the third respondent, dated 10.04.2024 and dated 29.05.2025 as illegal and consequentially direct the respondents to approve the petitioner's appointment as Office Assistant w.e.f., 27.11.2018, and pay arrears of salary with all consequential monetary benefits arising thereon within the period that may be stipulated by this Court.
2. The petitioner had been appointed as an Office Assistant on 27.11.2018 in the vacancy that arose in the 5th respondent on the incumbent being conferred with the promotion as Junior Assistant. Approval of the petitioner had been rejected, as there has been a District surplus in the aforesaid post.
3. I have considered the submissions made by the learned counsel appearing on either side and perused the materials placed on record. 2/5

The ground of District surplus could not be put against the petitioner as firstly the order of the Division Bench in W.A.(MD).No.76 of 2019, dated 31.03.2021 can only be applied prospectively and not to an appointment made before the judgment was delivered. Secondly, the Rules, which were framed by the Government with regard to surplus, had also been stayed by a Division Bench of this Court in respect of the minority institution. In view of the same, second reasons assigned also would have to fall.

For the aforesaid reasons, the Writ Petition is allowed and the impugned orders are set aside and there shall be a direction to the respondents to approve the appointment of the petitioner from the date of his original appointment and grant all monetary benefits. Such exercise shall be carried out by the third respondent within a period of twelve (12) weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed. 24.10.2025 Index : Yes / No Internet : Yes / No pbn 3/5
