O R D E R

An order dated 18.08.2025 of the first respondent is challenged primarily on the ground of breach of principles of natural justice.

2. Upon receipt of notice, the third respondent appears in person. He states that an inquiry notice was issued to the petitioner and that the petitioner participated in the inquiry.

3. On perusal of the impugned order, it is noticeable that the order has been dispatched to the petitioner. However, there is no reference in the order to the issuance of notices to the petitioner or to the dates of inquiry. In those circumstances, the benefit of doubt should be extended to the petitioner. Solely on this limited ground, the impugned order is set aside and the matter is remanded to the Revenue Divisional Officer for reconsideration. After providing a reasonable opportunity to the petitioner and the third respondent, a speaking order shall be issued within three months from the date of receipt of a copy of this order. For the avoidance of doubt, it is clarified that no opinion has been expressed on the merits.

4. This writ petition is disposed of on these terms without any order as to costs. Consequently, connected miscellaneous petitions are closed.
