ORDER : The Court Made the following order :- The petitioner is sole accused and he was arrested and remanded to judicial custody on 20.11.2013 for the alleged commission of offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, for having found in possession of 4 kgs of ganja, in Crime No.179 of 2013 on the file of the respondent police and hence, seeks bail. 2.The learned counsel for the petitioner would submit that the petitioner is falsely implicated and he is nothing to do with the alleged commission of offences and this case has been registered purely for statistical purpose.

3.The learned Government Advocate (criminal side) would submit that the petitioner was found in possession of 4 kgs of ganja and he is involved in one previous case in Cr.No.343 of 2009 and the investigation is pending.

5.This Court, taking into consideration of the fact that quantum of contraband is very much less than the commercial quantity and also considering the period of incarceration, is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is directed to be released on bail on executing a personal bond each for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District Judge for Principal Special Court for EC & NDPS Court, Madurai and on further condition that the petitioner shall appear before the respondent Police Station daily at 11.00 a.m for a period of three weeks and thereafter as and when required.
