O R D E R

The petitioner asserts title to the land of an extent of 26.5 ares in survey No.272 by way of succession from his late wife, Manimegalai. On the ground that the patta was mutated erroneously solely in the name of her son Naresh Kumar, the appeal was filed before the Revenue Divisional Officer. Thereafter, the patta transfer order impugned herein was issued by transferring the patta in the name of the third respondent herein.

2. Learned counsel for the petitioner points out that the present patta transfer has also been challenged by way of representation dated 2/5

20.08.2025 before the official respondents, including the Revenue Divisional Officer.

3. Learned Special Government Pleader accepts notice on behalf of respondents 1 and 2. He submits that the challenge to the present patta transfer is consequential to the challenge to the earlier patta transfer and that both proceedings would be consolidated and disposed of on merits by the Revenue Divisional Officer within a reasonable time.

4. Because the Revenue Divisional Officer, Karur, is the person authorised to consider appeals against patta transfer orders, the said Revenue Divisional Officer, Karur, is suo motu impleaded as a party in this Writ Petition. This order shall be issued after carrying out the amendments in this Writ Petition.

5. In view of the above submissions, it is not necessary to issue notice to the third respondent in these proceedings. Instead, this Writ Petition is disposed of on the following terms: i. The Revenue Divisional Officer, Karur is directed to consolidate 3/5

the proceedings relating to the patta transfer in the name of Naresh Kumar and the subsequent patta transfer in the name of Somasundara Chettiar and dispose of both proceedings jointly. ii. The said proceedings shall be disposed of by a speaking order after providing a reasonable opportunity to all the legal heirs of the late Manimegalai and Somasundara Chettiar. Such speaking order shall be issued within three (3) months from the date of receipt of a copy of this order.

iii. No costs. Consequently, connected miscellaneous petition is closed.
